Kevin Orcutt
For more than 20 years, Eastern Mass Hawks Academy Founder and President Kevin Orcutt has been a regular sight on the sidelines of the South Shore youth and high school lacrosse scene. Orcutt began his lacrosse career as a midfielder at Merrimack College in the late 80’s, one of the teams that laid the groundwork for the program’s ascent to the NCAA Division II varsity status in the ’90’s. Following his time at Merrimack, Orcutt took over head coaching duties at Derby Academy, and within only a few years, Derby was ranked on of the top middle school teams in New England and sent numerous talented young men to great institutions in the Independent School League and as well as other prestigious leagues in New England.
From Derby, he then established Cohasset as one of the top powers in the State in Division II and III. In 2004, he started a City lacrosse program in Quincy and led the Presidents to the State Tournament in three out of five years. A number of student athletes went on to excel in college lacrosse as well as to the next level. Martin Bowes was drafted in 2012 and went on to play for the Boston Cannons. Next it was to Abington High School, where he turned a 2-16 team into a strong DIII program with two consecutive tournament berths. Again, a number of student athletes went on to excel in college lacrosse. Sean Lawton went on to Western New England College and is now rostered on the Boston Cannons along with Martin Bowes.
Orcutt spent the next year as the Defensive Coordinator at the Massachusetts Maritime Academy. He built on the strong work ethic of the Cadets at MMA and worked with Jack Murphy (Cohasset) who would then move on to Fairfield University and then be drafted in the 2014 MLL Draft by the Boston Cannons. Orcutt earned a great opportunity the next year in going to lead the Boston College Eagles at Chestnut Hill. In his first season at the helm at Boston College, the Eagles finished at 13-1 with its only loss being in the National Championships in South Carolina and ending up finishing 8th in the Nation. He followed up in 2014 with an 11-4 campaign in 2014 with a rigorous schedule that earned them the 5th spot in the Nation in the MCLA Division 1.
Orcutt has earned numerous coaching awards over the past twenty years ranging from Pilgrim Conference Coach of the Year (Cohasset), South Shore League Coach of the Year (2x at Abington), Boston Globe Coach of the Year (Cohasset), and Pioneer Collegiate Lacrosse League Coach of the Year (Boston College). He now runs Hawks Academy in Rockland that works to give great opportunities to South Shore young men with some of the best coaches South of Boston.

Parent Letter and Agreement

Dear Parent,
Thank you for choosing Hawks Lacrosse for your child’s birthday experience. We truly want you to have the best birthday possible here at Hawks. Here are a few policies and reminders going forward.
Policies:
- The party fee is $250 and includes:
- rental of the field for one hour for 15 participants;
- rental of the party room for 30 minutes;
- a choice of cake/ice cream or 4 cheese pizzas;
- and paper goods and table cloth;
- A referee/organizer during field time is available for $25 cash;
- Skills, drills and games with Kevin are available for $50/hrly.
- Your field time may be used for lacrosse, football, soccer, wiffle ball or obstacle courses. Please let us know if you would like to deviate from this plan.
- All children attending the party must be supervised by two parents/guardians during the party time (one for the field and one for the lobby area). The parents must remain on the premises.
- You may choose to bring in a cake and ice cream if you do not opt for this as part of your plan. You may also bring in drinks for the party.
- Drinks may be purchased at the facility.
- We ask that you have your party guests fill out the waivers prior to arriving at Hawks Academy. These waivers will be emailed to you ahead of time.
- Payment of $250 will be made one week in advance of the party date by POS/check or cash.
- All participants on the field must be appropriately attired with equipment. Lacrosse players must have helmet, gloves and stick.
- We have enclosed a participation agreement (below) that you need to complete and return to us as soon as possible.

Facility Rental Contract
This agreement is made this _____________________ day of ____________________, by and between Hawks Lacrosse Academy (herein referred to as “Academy”) and _________________________________________________ (herein after referred to as “User”).
- PREMISES & RATES: The Academy hereby agrees to make available to User, for the exclusive use of User, the following facility (the “Facility”) located on the Academy premises, at the time and date (s) and for the purpose (s) indicated at the following rates.

Facility Rental Agreement continued:
- PAYMENTS: Payment in full is required with the return of this contract for facility rental within 30 days from the date of the contract. A deposit of 25% $______________ is required with the return of this contract to confirm the event dates. Also, due with the return of the contract is evidence of insurance coverage described within Section 7E. The balance of the total cost will be due in full thirty (30) days prior to the event.
- CANCELLATION:
- After approval is given, the Academy may terminate this Agreement (in its entirety, or as to any time, date or facility) in its sole discretion up-to one month prior to the first date in Section 1. After one month (30 days), the Academy may terminate this Agreement only for good cause. Upon such termination, and absent any default by User, all deposits shall be refunded to User less expenses incurred by the Academy in preparation of the Facilities for User prior to such termination; provided that if the termination is only partial, User shall be entitled to only a partial refund in an amount to be determined by the Academy in its sole discretion.
- User may terminate this Agreement at any time prior to fourteen (14) days in advance of the first date in Section 1 in which case User shall be entitled to a refund less (i) all expenses incurred by the Academy in preparation of the Facility for User and (ii) a cancellation fee of 35% with a minimum of $200.00.
- DEFAULT: If User shall at any time be in default under the terms of this Agreement, the Academy shall have the right to terminate this Agreement forthwith, whereupon User shall vacate the Facility immediately, and User shall have no right to receive any refund of any deposits of fees hereunder.
- USE RESTRICTIONS: The following restrictions shall apply to the User’s use of the Facility:
- All use of the Facility shall terminate no later than the time and date herein stated, and said Facility shall be vacated by all persons using the same hereunder at or before such time and date. Any time for User to set-up, tear down and remove equipment provided must be budgeted as part of the rental contract, Section 1 hereof. User will reimburse the Academy for any overtime compensation it is required to pay its staff during such additional time.
- User shall have the use of the Facility only for the purposes herein.
- User specifically agrees not to nail, tape, or screw anything to the floor or walls of Facility and shall be responsible for any and all damage to the Facility and to the Academy’s personal property therein, or to the property of any third person which is on loan to the Academy, caused by the acts of User or User’s agents, servants, employees, patrons, licensees, invites or guests, whether accidental or otherwise; and User further agrees to leave the premises in the same condition as existed on the date that possession thereof commenced which includes but is not limited to the removal of all trash generated by the event, removal of all equipment, beverages, food, etc. Failure to comply with facility cleanup policy will result in a cleaning charge of $25.00 per hour.
Facility Rental Agreement continued:
- User shall indemnify and hold the Academy harmless from and against any and all claims, damages, expenses, losses, suits or causes of action (including reasonable attorneys’ fees) resulting from or arising in connection with User’s use of the Facility, provided the Academy promptly notifies User of such claims, damages, expenses, losses or suits and cooperates fully with the defense thereof. Any use of the Facility involving a danger or risk determined by the Academy in its sole discretion, shall be covered by liability and property damage insurance provided by User, at User’s sole cost and expense and endorsed for the benefit of the Academy, with insurance companies acceptable to the Academy. The bodily injury liability coverage shall be not less than $1,000,000 each occurrence. The property damage liability shall be not less than $1,000,000 for each occurrence. The Insurance Certificate given by the User will record the Facility as “Additional Insured”. User will provide the Academy with evidence acceptable to the Academy that such insurance has been obtained and will cover User’s event at least fourteen (14) days prior to the first date set forth in Section 1, hereof.
- User agrees to comply with any and all laws, statutes, ordinances, rules, orders regulations and requirements of the federal, state, and local governments, and all of the their departments or bureaus, applicable to User’s use of the Facilities.
- User is responsible for the safety and good order of all equipment and other property owned by the Academy, and is liable for said equipment and other property if it is lost, stolen, damaged or misplaced by User’s agents or the attendants at User’s function whether or not invited.
- The Academy reserves the right through its officers and its employees or agents to eject any person or persons from any portion of its Facility, and upon the exercise of this authority, through its employees, officers, or agents, the User hereby waives any right or claim for damages against the Academy or any of its employees, officers, or agents.
- The Academy assumes no responsibility for equipment supplied by User or another party. The Academy reserves the right to approve (1) all equipment used.
- The Academy reserves the right to review all copy and approve all forms of advertising or publicity in which the Academy’s name is used. The parties agree that no partnership between them respecting any event or the use of the Facility shall be implied in any way, and User agrees to indemnify and hold the Academy harmless from and against any claims to the contrary.
- User agrees that it shall not erect, post, place or affix any signs, advertisements, show bills, lithographs, posters or cards of any description on any portion of the Facility without written permission of the Academy. Should written permission of Academy be obtained for the erection, posting, placing or affixing of any sign, advertisement, poster, show bills, lithographs, or cards, the said erecting affixing, etc., shall be supervised by the Facility Owner. If this covenant is in any way violated by User the Facility retains the right to exercise its remedies under this lease and cause the tenancy to be terminated from time of said breach.
- All of the user’s property will be removed from the Academy by User at the termination of the User’s use of the Facility. If User’s property is not removed as provided herein, the Academy will have the right to cause such property to be removed at the expense of the User.
- User shall comply with all rules and restrictions that may be prescribed by the Academy for the
purpose of maintaining the safety, care, good order and cleanliness of the Academy’s premises, equipment and property displayed thereon.
Facility Rental Agreement continued:
- Those matters not herein expressly provided for shall be decided by the Academy and/or its representatives or agents and such decisions shall be binding upon the User.
- NOTICES: All notices to the Academy shall be deemed to have been adequately and timely given when received in writing by the Academy’s Owner.
- MISCELLANEOUS: This Agreement constitutes the entire Agreement between the parties hereto and shall not be modified except by written instrument signed by both parties. This Agreement shall be construed, interpreted and enforced according to the laws of the State of Massachusetts. The officer or representative of User executing this Agreement certifies that he or she has been duly authorized to enter into this Agreement on behalf of User and that neither the execution of and delivery of this Agreement, nor the performance or the terms and conditions hereof, will result in a breach of any agreement to which User is a party, or of any federal, state or local law, rule or regulation.

PARTICIPATION AGREEMENT, RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISK
BY SIGNING THIS DOCUMENT YOU MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
TO: Eastern Mass Hawks L.L.C. dba Hawks Lacrosse Academy and the Program and/or League of which I am a participant in (“Program” and/or “League”) and their owners, officers, directors, agents, employees and/or representatives (collectively “Releasees”):
ASSUMPTION OF RISK: I am aware that sport-play involves certain inherent risks, dangers, and hazards, which can result in serious personal injury or death. I am also aware that sports complexes contain potential dangers to the sport-playing public. As such, I hereby freely agree to assume and accept any and all known and unknown risks of injury while participating in sports activities at the complex known as Hawks Lacrosse Academy located at 22 Reservoir Park Drive, Suite 4, Rockland, Massachusetts (the “Complex”). I further recognize and acknowledge that the risks inherent in sport-play can be greatly reduced by: taking lessons, abiding by Program and/or League and/or Complex rules/regulations and using common sense.
RELEASE AND WAIVER OF CLAIMS AGREEMENT: In consideration of allowing me to participate in the Program’s and/or League’s sport-play activities at the Complex, I hereby, to the fullest extent permitted by law:
1. WAIVE ANY AND ALL CLAIMS that I have or may in the future have against each of the Releasees resulting from the League’s activities at the Complex.
2. RELEASE each of the Releasees from any and all liability for any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer, as a result of my participation in the activity described in this Agreement, due to any cause whatsoever, including negligence or breach of contract on the part of the Releasees in the operation, supervision, design or maintenance of the Complex.
3. PUBLICITY RELEASE: “I understand that Eastern Mass Hawks LLC retains the right to use for publicity and advertising purposes, photographs of participants taken during camps/clinics/club teams/training sessions/leagues.”
ARBITRATION: In further consideration of allowing me to participate in the Program’s and/or League’s sport activities in the Complex, I hereby agree to submit to binding arbitration any and all claims which I believe I may have against the any of the Releasees arising from the Program’s and/or League’s activities at the Complex. The arbitration shall be pursuant to the rules of the America Arbitration Association. The arbitrators shall apply the Federal Rules of Evidence to all proceedings.
Arbitration shall be commenced within one (1) year from the date on which any alleged claim first arose. Further, the arbitration shall be held in the town where the Complex is located, unless otherwise mutually agreed to by all the parties. The submission to the American Arbitration Association shall be unlimited and the arbitration award may be enforced by any court of competent jurisdiction.
SEVERABILITY: I further agree that the foregoing is intended to be as broad and inclusive as is permitted by the Commonwealth of Massachusetts and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal effect.
BINDING EFFECT OF AGREEMENT: In the event of my death or incapacity, this Agreement shall be effective and binding upon my heirs, and legal representatives, or assigns.
ENTIRE AGREEMENT: In entering into this Agreement, I am not relying upon any oral or written representation other than what is set forth in this Agreement.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASEES.

Player Waiver and Release of Liability New England Lacrosse Classic November 13 2016
In consideration of being allowed to participate in the New England Lacrosse Classic (the “camp”) sponsored by Grow the Game, LLC. (“Company’) and related events and activities, the undersigned acknowledges, understand, and agrees that:
- I hereby agree to behave in a responsible manner during the tournament. I understand that anyone who does not follow the rules of the camp will be sent home.
- The risk of injury from the activities involved in the program of the camp is significant, including potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce the risk, the risk of serious injury does exist; and
- I knowingly and freely assume all such risks, both known and unknown, even is arising from the negligence of the company, its officers, shareholders, directors, officials, agents, coaches and or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the camp (the “releases”_ and I assume full responsibility for my participation; and
- I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such attention of the nearest staff/official immediately; and
- I, for myself and on behalf of my hears, assigns, personal representatives and next of kin, hereby release and hold harmless the releases with respect to any and all injury, disability, death, or loss, or damage to person or property, whether arising from the negligence of the releases or otherwise unless caused by the willful, wanton and intentional conduct of the releases.
I have read the release of liability and assumption of risk agreement, fully understand and it’ terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without and inducement.
